The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 294(b), 323, 324, 307 & 506(ii) of IPC in Crime No.308 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 12.08.2023, at about 06.40 a.m., when the de-facto complainant was walking on the left side of the Krishnapuram Road, the petitioner herein dashed him with his tractor and started abusing him with filthy language. The petitioner herein has also hit him and pushed him down. As the defacto complainant started shouting for help, the neighbours came to the spot and tried to save him. At that time, co-accused Saravanan and Mani also came to the spot and started attacking the de-facto complainant. Hence, the complaint.
3. The learned counsel for the petitioner stated that the petitioner and the de-facto complainant are relatives. Due to the family property dispute, on 07.12.2022, the father of the petitioner
herein was murdered by the de-facto complainant and others, which resulted in a case being registered against the de-facto complainant herein. Hence, on the date of occurrence, due to a wordy quarrel with this petitioner, the de-facto complainant has lodged a false complaint.
4. Heard the learned Government Advocate (Crl.side).

On perusal of the complaint, I find that, on the occurrence date, this petitioner was riding a tractor and tried to dash against the de-facto complainant and uttered filthy language and the nearby persons have saved him. Subsequently, he has uttered obscene words and criminally intimidated them. He has thrown a brick on the head of the de-facto complainant and the said person has suffered injuries on the head.
6. Considering the nature and gravity of the offence alleged, overt act against the petitioner and the injuries sustained on the head by the de-facto complainant, I am not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original petition is
dimissed.
