O R D E R

The petitioner, who was arrested and remanded to judicial custody on 08.04.2025 pursuant to the non-bailable warrant issued in S.C.No.51 of 2024 on the file of the IV Additional District Judge, Tiruvallur at Ponneri, in connection with Crime No.896 of 2023 registered for the offences punishable under Sections 120(B), 147, 148, 450 302 (3 count), 149 of IPC, seeks bail.

2. It is the case of jumped bail. Since the petitioner failed to appear before the trial Court in S.C.No.51 of 2024, a non-bailable warrant of arrest was issued against him on 25.03.2025 and pursuant to the same, he was arrested and remanded to judicial custody on 08.04.2025.

3. The learned counsel for the petitioner submitted that the petitioner was arrested in this case and granted bail by this Court. Thereafter, since the petitioner had some criminal antecedents, Crime No.202 of 2025 registered against him for possession of Narcotics substance and he was arrested in that case on 18.03.2025. For that reason, the petitioner was unable to appear 2/5

before the trial Court in S.C.No.51 of 2024. Hence, Non-Bailable Warrant issued on 25.03.2025 and executed on 05.04.2025. Hence, he prayed for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) appearing for the respondent police strongly opposed the grant of bail to the petitioner stating that in this case there are totally 9 accused including one Juvenile. The petitioner is arrayed as A4. It is a case of triple murder. He further submitted that there are totally 47 listed witnesses. So far 27 listed witnesses examined. Out of remaining 20 listed witnesses, 10 witnesses to be examined. The eyewitnesses confirm the case of the prosecution. The specific overt act of the petitioner has been clearly spoken by the eyewitnesses. Further the petitioner filed a petition under Section 311 of Cr.P.C. to recall the witnesses and the same was allowed. The case is posted to 12.08.2025 for cross examination of the witnesses. At this stage, if bail is granted, there is every possibility of tampering witnesses and the witnesses may be forced to resile. 3/5

5.Considering the submissions made on either side, the facts and circumstances of the case and the grave nature of offence, this Court is not inclined to entertain this bail petition and the same is dismissed. 07.08.2025 rsi To 1.The IV Additional District Judge, Tiruvallur at Ponneri.
