Respondents [R-2 is suo motu impleaded as per order dated 03/11/2016 in W.P.No.33930 of 2016] PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent to extend the contract for operation and maintenance of the Gasifier Crematorium at Kasimedu burial ground to the petitioner for the calender year 2016-2017 by considering quotation submitted by the petitioner dated 01.09.2016. The petitioner sought for writ of mandamus, directing the respondents to extend the contract for operation and maintenance of Gasifier Crematorium at Kasimedu burial ground to the petitioner for the calender year 2016-2017.

2. The petitioner participated in the tender for main operation and maintenance of Gasifier Crematorium at Kasimedu burial ground for the year 2015-2016 and the period has come to an end on 25.08.2016. However, there is a delay in floating the tender. After the expiry of period, the Corporation has allotted the operation and maintenance of Gasifier Crematorium to some third parties. Therefore, the petitioner has approached this Court.
3. Heard Mr.A.V.Raja, learned counsel appearing for the petitioner and Mr.V.Ayyadurai, learned Additional Advocate General appearing for the respondents.
4. As per the directions of this Court, the amount due to the petitioner has been paid to him, which fact has been vouched by the learned counsel appearing for the petitioner. Further, it is submitted by the learned Additional Advocate General that the tender has been called for and the bid is to be opened on 18.11.2016. In view of the above circumstances, the petitioner is at liberty to take part in the bid and based on the value secured by the parties, it is open to the respondents to decide about the contract.
5. With the above directions, the Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
