PRAYER: Original Petition filed under Order Section 372 of the Indian Succession Act read with Order XXV Rule 6 of O.S.Rules, prays that a Succession Certificate may be granted to the Swarnalatha B the first petitioner herein with the power to collect the securities and to receive the interest and dividends on the negotiate and transfer the securities specified in the schedule hereto.

ORDER

The petitioners seek Succession Certificate in favour of the first petitioner in respect of the securities held by Late.Babu.V, who died intestate on 01.08.2021. The petitioners are the wife and children of the deceased.

2. The third petitioner has been examined. He has produced the death certificate of the deceased as Ex.P1. The legal heir certificate of the deceased 1/4

as Ex.P2. On perusal of Ex.P2, it shows that the petitioners are the wife and the children of the deceased and only surviving legal heirs of the deceased.

3. The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the petitioners are entitled to the relief.

4. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the first petitioner, with the power to collect the securities and receive the interest and dividends mentioned in the schedule to the petition.
