2025-08-19Honourable Mr Justice M. Sundar,Honourable Mr.Justice Hemant Chandangoudar3 pages

W.M.P.No.30516 of 2025 in W.P.No.9364 of 2023 M.SUNDAR, J., and HEMANT CHANDANGOUDAR, J., ., (Order of the Court was made by M.SUNDAR, J.,) There are three writ petitioners in the captioned main 'Writ Petition' {hereinafter 'WP' for the sake of brevity, convenience and clarity}.

2. Pending captioned main WP, second petitioner Ms.Parvathi Palaniappan died and the date of demise (we are informed) is 04.06.2024. This has necessitated the captioned 'Writ Miscellaneous Petition' {hereinafter 'WMP' for the sake of brevity, convenience and clarity} which has been filed to bring on record three daughters of the deceased Parvathi Palaniappan (daughters of first petitioner Mr.E.M.C.Palaniappan too) as co-writ petitioners.

3. Interestingly and intriguingly, writ petitioner Nos.1 and 3 for whom, learned counsel for WMP petitioners is holding vakalatnma have been arrayed as R4 and R5 in the captioned WMP. Nonetheless, we exercise our inherent powers in the writ jurisdiction, treat R4 and R5 in the captioned WMP also as co-petitioners as requested by learned counsel for WMP petitioners and turn to the other respondents. To be noted, other 1/3

respondents constitute State. Mr.T.K.Saravanan, learned Additional Government Pleader very fairly submitted that the implead prayer being innocuous is not being opposed.

4. Captioned WMP ordered as prayed for and three WMP petitioners shall now become writ petitioners 4, 5 and 6 respectively. Registry is directed to do necessary and consequential amendments in the captioned main WP.

Captioned WMP ordered in the aforesaid manner. There shall be no order as to costs.
