PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, for a direction to the learned Additional District and Sessions Judge - III at Poonamallee to dispose of the suit in O.S.No.536 of 2021 within a time fixed by this Court. For Petitioner : Mr.R.Jayaprakash
O R D E R
The civil revision petition seeks for expeditious disposal of O.S.No.536 of 2021 on the file of the learned Additional District and Sessions Judge - III at Poonamallee.
2. When the matter came up for admission on 10.09.2024, I called for a report from the learned Judge as to how long he requires to dispose of the said suit. The learned Additional District and Sessions Judge - III, Tiruvallur at Poonamallee has submitted a report stating that the civil revision petitioner, who is a minor, has initiated a suit through his mother in O.S.No.536 of 2021. Defendants 1 to 3, 7 & 8 have filed their written statements. Defendants 6 & 9 to 11 were set exparte. The report further states that on the memo filed by the plaintiff requesting that the matter be referred to Lok Adalat, the case records were sent to the Taluk Legal 3/5
Services Committee, Poonamallee for settlement and is awaited report. He further states that he is holding full additional charge for III Additional District and Sessions Judge, Poonamallee, since the regular Judge is on medical leave. Therefore, he requests five months time to dispose of the suit.
3. Taking into consideration the report of the learned Judge, there shall be a direction to the learned Additional District and Sessions Judge - III at Poonamallee to dispose of the suit in O.S.No.536 of 2021 within a period of seven months from the date of receipt of a copy of this order.
4. Accordingly, the civil revision petition stands ordered. There shall be no order as to costs.
