Writ Petition filed under Article 226 of the Constitution of India praying the issue a Writ of Certiorarified Mandamus, to call for the records and to quash the order passed by the 1st respondent in his proceeding Pa.Mu. 20508/2015/J2 dated nil 09.2016 signed on 22.09.2016 and to restore the subject matter of agricultural properties comprised in S.No. 177 , 179 and 193 in the name of the petitioner family in Patta No. 617 situated at Thandarai Village Hosur Taluk Krishnagiri District. JUDGMENT
(Delivered by The Hon'ble Chief Justice) We have heard learned counsel for the parties and we find that the litigative history of the property in dispute spans over almost six decades. The present proceedings are only a fallout of the intervening litigations that have been narrated in detail in the papers filed on record.
2. The learned Single Judge while disposing of the writ petition on 12.6.2018 made certain observations that gave rise to two contempt petitions. In Contempt Petition No.590 of 2019, orders were passed by a learned Single Judge and a copy of the same has been produced by the learned counsel for the fourth respondent, which is on record. A perusal of the said order demonstrates that pursuant to the order of the learned Single Judge in the writ petition giving rise to this appeal, the learned Judge hearing the contempt matter has clarified the same which boils down to that the authorities shall continue to keep any further action in abeyance till the Second Appeals pending before this Court are finally disposed of.
3. In view of this subsequent development, which stands recorded in the order dated 16.4.2019, we find it expedient and in the interest of justice to get the matter resolved at the earliest in order to draw a curtain on this age old litigation in respect of the property in dispute.
4. We, therefore, dispose of this appeal with the observation that the Registrar (Judicial) shall list the Second Appeal Nos.186 of 2012, 738 of 2012 and 215 of 2013 before the Bench according to the roster prescribed upon obtaining orders from the Chief Justice on the administrative side within 15 days from today. No costs. Consequently, C.M.P.No.24119 of 2019 is closed.
