This petition has been filed seeking to condone the delay of 265 days in filing the appeal.

2. Heard the learned counsel for the petitioner.

3. Despite the receipt of notice, on behalf of the first respondent, none represented.

4. The learned counsel for the second respondent does not have serious objections in allowing the petition.

5. The petitioner would aver that he is unable to continue his work due to the injuries sustained on account of the accident daughter had been taking treatment for more than one year. After the accident, he was unable to attend his job and he is the sole bread winner and taking care of the family. He has been struggling to take care of his needs and meet day-to-day expenses. Hence, the delay of 265 days occurred in filing the appeal.

6. Accepting the averments made by the petitioner, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 265 days shall stand waived. 03.11.2025 kmm https://www.mhc.tn.gov.in/judis
