2021 dated 18.04.2023 without reference to allotment to Corporation Schools based on roster seniority and the subsequent transfer to School Education Department and to consider the petitioners for promotion to the Higher Secondary School Headmaster based on 2025 panel, based on the representation submitted by the petitioners dated 06.06.2025 and 31.05.2025 respectively.

The instant Writ Petition has been filed by the petitioners to direct the respondents to pass orders for inclusion of the name of the petitioners in the seniority of selectees to the post of P.G. Assistant 2005 published by the 2nd respondent in Na.Ka.No.014360/W1/E1/2025 dated 23.04.2025 for the subject P.G. Assistant (Chemistry) and P.G. Assistant (Botany) respectively in accordance with the marks secured by the petitioners in the selection as per the orders of the Hon'ble Supreme Court of India passed in Contempt Petition (D) No.6415 of 2021 dated 18.04.2023 without reference to allotment to Corporation Schools based on roster seniority and the subsequent transfer to School Education Department and to consider the petitioners for promotion to the Higher Secondary School Headmaster based on 2025 panel, based on the representation submitted by the petitioners dated 06.06.2025 and 31.05.2025 respectively.

Learned counsel for the petitioners would submit that, in view of the judgment of the Hon'ble Supreme Court to revise the seniority based on merits, as contemplated under Section 40(6) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016 has given a representation for revision of seniority and such representation is pending with the respondents.
3. Learned Special Government Pleader appearing for the respondents would submit that they already sanctioned the promotion and promoted persons have already took charge of their postings. Therefore, there is no purpose in considering the petitioners representation.
4. Though the learned Special Government Pleader would submit that, already promotion order had been issued, the fact remains that the petitioners' representation for revision of seniority dated 31.05.2025 and 06.06.2025 respectively is pending with the respondents.

Hence, without going into the merits, this Court deems it appropriate to direct the second respondent to consider the petitioners representation dated 31.05.2025 and 06.06.2025 respectively, on its own merits and in accordance with law within a period of eight weeks from the date of receipt of copy of this order.
6. This Writ Petition is disposed of with the above direction. Consequently, connected miscellaneous petition is closed.
