This criminal original petition has been filed seeking to enlarge the petitioner on bail in respect of Crime No.396 of 2022 registered for the offence under Sections 294(b), 324, 307 & 506(2) IPC, on the file of the respondent Police.
2. The case of the prosecution is that on 16.09.2022, due to previous enmity, the petitioner along with the other accused abused the de-facto complainant in a filthy language and indiscriminately assaulted him with knife, due to which, he sustained grievous injuries on his head and other vital parts of the body. Hence the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that there was a previous
enmity between the first accused and the de-facto complainant and the petitioner is no way connected with the alleged offence. He would also submit that the petitioner is in custody from 18.09.2022 and he is ready to comply with any stringent condition imposed by this Court and hence, he prays for grant of bail to the petitioner.

The Government Advocate (Crl.Side) appearing for the respondent police would submit that the petitioner along with the other accused abused the de-facto complainant in a filthy language and assaulted him brutally with knife and caused grievous multiple injuries. He would also submit that the injured is still in the hospital. Therefore, he vehemently oppose to grant bail to the petitioner.
5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.
6. Taking into consideration the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl.Side) and also considering the fact that the injured is still in hospital, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition stands dismissed for the present.
