This application has been filed by the applicant / plaintiff to grant leave to sue the respondent / defendant before this Court.

2. The plaintiff has filed a suit for directing the defendant to pay a sum of Rs.1,00,5,000/- as damages for the injury suffered by the plaintiff due to the defamatory statements made by the defendant against the plaintiff and for permanent and mandatory injunction.

3. According to the learned counsel for the applicant / plaintiff, the suit has been filed for damages against the defendant. Even though the cause of action is well within the jurisdiction of this Court, the defendant is residing outside the jurisdiction of this Court. Hence, this leave application is filed.

4. Considering the submission made by the learned counsel for the applicant / plaintiff and considering the averments made in this application and in the plaint, leave is granted.

5. Accordingly, this application is allowed.
