ORDER
This writ petition has been filed challenging the impugned communication of the 3 rd respondent dated 29.04.2025 and for a consequential direction to the 3 rd respondent to register the new Association named as NAWA (Nova Apartments Welfare Association) by considering the online application submitted by the petitioner.

2. When the matter was taken up for hearing today, the learned Additional Government Pleader appearing on behalf of the respondents produced the written instruction received from the 3 rd respondent. On going through the same, it is seen that the 3 rd respondent is refusing to entertain the application mainly on the ground that the petitioner attempted to register themselves under the Tamil Nadu Societies Registration Act, 1975, whereas, if an application is submitted under the Tamil Nadu Apartment Ownership Act, 2022, the 3 rd respondent is willing to entertain the same and consider the application.
3. In light of the above stand taken by the 3 rd respondent, there shall be a direction to the petitioner to file a fresh application online, under the Tamil Nadu Apartments Ownership Act, 2022. On receipt of the same, the 3 rd respondent shall act upon the application and take a decision within a period of four (4) weeks from the date of receipt of a copy of this order. Page No.3 of 6
