This petition is filed to relax the condition imposed on the petitioners vide order dated 09.08.2023 to report before the respondent police daily at 10.00 a.m. until further orders.

2. Learned counsel for the petitioners states that as per the direction of this Court while granting bail a sum of Rs.45 lakhs has been deposited as surety in the credit of Crime No.208 of 2023 and appearing before the respondent police daily at 10.00 a.m since 10.08.2023. He further states that the first petitioner is a Site Engineer and the second petitioner is a Site Manager and the incident as alleged to have been occurred due to negligence of the workers in the Site. Hence, they seek relaxation of the condition imposed by this Court. 3.The learned Additional Public Prosecutor states that the petitioners are complying the condition regularly without fail and the substantial portion of the investigation is completed.

4. Considering the nature of the crime and compliance of the condition so far and the stage of the investigation, bail condition is modified to the effect that the petitioners shall report before the Investigating Officer on summons if required by the Investigating Officer.
