Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, direct the 1st and 2nd Respondents herein to consider the Petitioner representation dated 09.05.2025 and consequently direct the Respondents to Cancel/Remove the Assessment of Property Tax, Water and Sewerage Tax and Electricity Connections assessed in the name Mr.B.Murgadoss/4th Respondent herein and to transfer the assessment in the name of Petitioner within a time frame as fixed by this Honble Court For Petitioner : Ms.K.Kaviya For Respondent : Dr.Paul Sundar Singh, St Counsel For R3 Mr.D.B.R.Prabhu, St Counsel For Rr1 And 2

This writ petition has been filed to direct the 1st & 2nd respondents to consider the petitioner's representation dated 09.05.2025 2/6

2. Dr.Paul Sunder Singh, learned Standing counsel and Mr.D.B.R.Prabhu, learned Standing counsel, takes notice on behalf of the respondents. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

3. The learned counsel for the petitioner would submit that in this case, initially, the petitioner, who had succeeded the subject property as a beneficiary of the Will dated 07.03.1996, is the absolute owner of the said property. However, due to misappropriation, the subject property was leased out, by the executor of the Will, to the 4th respondent vide illegal lease deed dated 30.11.1998, which was challenged by way of a O.S.No.624 of 2015, whereby the said lease deed was declared as null and void vide judgement dated 28.02.2025. Pursuant to the said judgement, a representation was filed by the petitioner to remove the name of 4th respondent in the assessment of property tax, water and sewerage tax, etc., and to assess the same in the name of the petitioner. However, the said representation was not at all considered by the respondent till date. Hence, this writ petition. 3/6

4. In reply, the learned Standing counsel appearing for the respondents would requests this Court to pass appropriate orders directing the respondents to consider and dispose of the representation filed by the petitioner.

5. Heard the learned counsel for the petitioner and the learned Standing counsel for the respondents and also perused the materials available on record.

6. In the case on hand, the petitioner, who is the absolute owner of the said property, has filed a representation dated 09.05.2025 to remove the name of 4th respondent in the assessment of property tax, water and sewerage tax, etc., and to assess the same in the name of the petitioner. However, the said representation was not considered by the respondents till date.

7. In view of the above, this Court directs the respondents to consider the petitioner's representation dated 09.05.2025 and dispose of 4/6

the same on its own merits and in accordance with law within a period of 8 weeks from the date of receipt of copy of this order.

8. With the above directions, this writ petition is disposed of. No costs.
