This petition is filed to enlarge the petitioner on bail in S.C.No.86 of 2023 on the file of the learned IV Additional Sessions Judge, Chennai. 2.It is the submission of learned counsel for the petitioner that petitioner was an accused in S.C.No.86 of 2023 on the file of the learned IV Additional Sessions Judge, Chennai. Petitioner was not able to appear before the Court on 09.02.2023 and the Court issued NBW against him. He was arrested on NBW on 28.04.2023 and since then, he is in judicial custody. Thus, he seeks bail.
3.The learned Additional Public Prosecutor strongly opposed this petition on the ground that this case was registered in the year 2010 in Cr.No.42 of 2010. After filing final report, the case was taken on file in P.R.C.No.442 of 2010. This case was committed to Sessions Court and taken on file in S.C.No.465 of 2012. Petitioner has not appeared before the Court in S.C.No.465 of 2012 and therefore the cases against him was split up in S.C.No.86 of 2023 and pending. Even after the split up of S.C.No.86 of 2023, petitioner was not regular. Because of absence of petitioner, there 1/3
is no progress in the trial of the case. Thus, he prays for dismissal of this petition.
4.Considering the rival submissions and perused the records. 5.Considering the reasons stated by the learned Additional Public Prosecutor that the murder had taken place in 2010 and that petitioner was not regular in appearing before the Court and not co-operating for the trial, despite, the case against him is split up, this Court is not inclined to grant bail to the petitioner.
6.Accordingly, this Criminal Original Petition is dismissed. 30.08.2023 ep 2/3
