PRAYER:

Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, directing the 2nd respondent to consider the petitioners representation dated 03.05.2019 and 14.08.2019 and to hand over the possession of the Petitioner property.

O R D E R

The limited prayer sought for in the present Writ Petition is for a direction to the 2nd respondent to consider the petitioner's representation dated 03.05.2019 and 14.08.2019. https://hcservices.ecourts.gov.in/hcservices/

2.Whenever a representation of its nature is made, the statutory application is to bound to consider such a representation in accordance with law and keeping it pending indefinitely would amount dereliction of original duties and as such, this Court may be justified in invoking its power under Article 226 of the Constitution of India to direct the respondent.

3.In the light of the above observations there shall be a direction to the 2nd respondent to consider the petitioner representation dated 03.05.2019 and 14.08.2019 and take appropriate action on its own merits and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this Order.

4.Accordingly, this Writ Petition stands disposed of. No costs.
