O R D E R

The petitioners, who apprehend arrest for the alleged offences punishable under Section 194 of B.N.S.S altered to Sec.108 of B.N.S (Sec.174 of Cr.P.C @ 306 of I.P.C) in Crime No.36 of 2025, on the file of the respondent police, seeks anticipatory bail. 1/5

It is the case of the prosecution that the 1st petitioner is the wife of the deceased, 2nd petitioner is the Mother in law, 3rd petitioner is the Brother in law, 4th petitioner is the Sister in law to the deceased and the 5th petitioner is the distant relative of 3rd petitioner. Mr.Bheemappa, father of the deceased Sunil Kumar, lodged a complaint stating that on 24.01.2025 around 5.00a.m., his grandson Pranav informed him that Sunil Kumar, an Inspector in CISF, Thakkolam Division, had committed suicide by hanging due to family dispute and depression. He immediately informed the police. It is pertinent that in the first information dated 24.01.2025, the complaint clearly stated there was no suspicion in the suicide. Hence, the complaint.

3. The learned counsel appearing for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed for grant of anticipatory bail to the petitioners. 5.Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

6. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, before the learned Judicial Magistrate, Sholingur, Ranipet District on condition that the petitioners 2/5

shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:

[a] the petitioners and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.

[b] the petitioners shall co-operate with the investigation and directed to report before the respondent police as and when required;

[c] the petitioners shall not tamper with evidence or witness either during investigation or trial. [d] the petitioners shall not abscond either during investigation or trial.

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.. 08.09.2025 nvi Note :
