Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the 1st respondent to refund the purchase price of Rs.42,25,000/- (Rupees Forty Two Lakhs Twenty and Twenty Five Thousand only) to the petitioner with interest payable for a fixed deposit from the date of deposit of the amount to till date of realization together with Rs.2,80,544/- (Rupees Two Lakhs Eighty Thousand Five Hundred and Forty Four only) towards stamp duty and further paid a sum of Rs.11,666/- (Rupees Eleven Thousand Six

Hundred and Sixty Six only) towards registration charges, thus, the petitioner have totally paid a sum of Rs.45,17,210/- (Rupees Forty Five Lakhs Seventeen Thousand Two Hundred and Ten only). For the Petitioner :

(Made by the Hon'ble Chief Justice) We have heard Mr.Abdul Mubeen, learned counsel for the petitioner and Mr.Om Prakash, learned Senior Advocate for respondent No.1. None appears for respondent No.2

2. The learned counsel for the petitioner submits that as the judgment of the Appellate Tribunal has been set aside and the matter is remitted to the Appellate Tribunal, vide order passed today in W.P.No.23009 of 2023, at present the petitioner does not press the present writ petition.

The writ petition as such is disposed of. There shall be no order as to costs.
