This application is filed to condone the delay of 29 days in filing OPD No. 908 of 2017 to set aside the arbitration award dated 07.09.2016.

2. I heard the learned counsel for the applicant and the learned counsel for the respondent.

3. The learned counsel for the applicant submits that the photo copy of the impugned order was served on the petitioner only on 16.09.2016 and there is a delay of 29 days in filing the petition on account of the reasons beyond the control of the petitioner.

4. On considering the oral submission and the averments in the affidavit in support of the application, I find that the applicant has made out sufficient cause to condone the delay. Accordingly, the delay is condoned.

5. Accordingly, the registry is directed to number the Original Petition, if it is otherwise in order.
