ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 273 and 328 of IPC and Sections 6, 7 and 24(1) of Cigarette and Other Tobacco Products Act, 2003 in Crime No.372 of 2021, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused persons had illegally transported banned tobacco products worth about of Rs.10,95,600/- Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that based on the confession statement of A1, the petitioner was falsely implicated in this case. 4. The learned Government Advocate (Crl.Side) submitted that the petitioner along with other accused persons had illegally transported banned tobacco products worth about of Rs.10,95,600/-. He further submitted that co-accused had already been arrested and remanded to judicial custody and the investigation is pending, the custodial interrogation is very much required. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case and also the fact that the petitioner is involved in a very serious offence and the investigation is at initial stage, this Court is not inclined to grant anticipatory bail to the petitioner.
