The petitioner namely Nagu @ Nagaraj (Arupu Nagaraj), who was arrested and remanded to judicial custody on 28.07.2023 for the offences punishable under Sections 379 and 430 IPC in Crime Nos.323 of 2023 on the file of the respondent police, seeks bail.

2. Learned counsel for the petitioner submitted that, petitioner is falsely implicated in this case in Crime Nos.323 of 2023 for the offences under Sections 379 and 430 IPC. Petitioner is in judicial custody from 28.07.2023. Thus, he prays for dismissal of this petition. 3.Learned Additional Public Prosecutor opposes this petition, on the ground, on 22.06.2023 at about 8.30 a.m., defacto complainant found the accused illegally transporting 1/4 unit of sand in TATA AC vehicle near Vellore to Arcot Road. He further submitted that, petitioner has 23 similar cases pending against him. Thus, he prays for dismissal of this petition.

4.Considered the rival submissions and perused the records. 5.It was submitted by the learned counsel for the petitioner that petitioner fell in the bathroom and suffered bone fracture prior to his arrest in this case. Therefore, he seeks bail on medical ground. This Court directed the learned Additional Public Prosecutor to verify petitioner's health condition. It is informed by the learned Additional Public Prosecutor, after verification that petitioner's health condition is good.

6.Considering the submission of learned counsel appearing for parties, the fact that petitioner has twenty-three similar cases pending against him and that investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 08.09.2023 ep
