The petitioners who apprehends arrest at the hands of the respondent police for the offences punishable under Section 6(4) of TNSC (RDCS) Order 1982 r/w 7(i) a(ii) of E.C Act 1955, in Crime No.60 of 2022.

2. The case of the prosecution is that the petitioners along with other accused illegally transported 20 tonnes of PDS rice by truck bearing Registration No.TN50J4416. Hence, the case.

3. The learned counsel for the petitioners would submit that the petitioners are innocent person and they have been falsely implicated in this case. He would further submit that in this case, the main accused have been arrested and they were released on bail. Therefore, he prays for grant of anticipatory bail to the petitioners.

4. Per contra, the learned Government Advocate (crl.side) appearing for the respondent would submit that the petitioners have illegally transported 20 tonnes of PDS rice. He would further submit that already this Court dismissed the petitioners' earlier anticipatory bail petition in Crl.O.P.No.23087 of 2022 dated 23.09.2022 and there is no change of circumstances. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

Taking into consideration the facts of the case and the submissions made by the learned counsel and also taking note of the fact that the quantity involved in this illegal transportation is huge and earlier this Court had dismissed the anticipatory bail petition of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this Criminal Original Petition stands dismissed. However, each of the petitioners shall pay a sum of Rs.5,000/- (Rupees Five Thousand only) as cost to the Tamil Nadu State Legal Services

Authority, Chennai within a period of fifteen days from the date on which the order copy is made ready.
