ORDER
The petitioners who apprehend arrest for the alleged offences under Sections 191(2), 191(3), 127(1), 296(b), 118(1) and 351(3) and 109 of BNS, 2023 in Crime No. 209 of 2025 on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that due to previous enemity between the defacto complainant and the accused, the accused attacked the defacto complainant with iron rod and wooden log. Due to the same, the defacto complainant sustained injuries and admitted in the hospital. 3.The learned counsel for the petitioners submitted that the petitioners and the defacto complainant are neighbours. There was a wordy quarrel between them with regard to drainage issue. The petitioners have been falsely implicated in this case. The petitioners are ready to abide by any condition that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioners.
4.The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioners attacked the defacto complainant 2\6
with iron road and wooden log. Due to the same, the defacto complainant sustained injuries and subsequently, discharged from the hospital. Further, A3 and A7 were arrested and released on bail by the learned Principal District Judge, Cuddalore. Hence, he vehemently opposed to grant bail to the petitioners.
5.Considering the facts and circumstances of the case, and the injured has been discharged from the hospital, I am inclined to grant anticipatory bail to the petitioners.
6.Accordingly, the petitioners are ordered to be released on anticipatory bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate No.I, Vridhachalam, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:
(a)the petitioners and the sureties shall affix their photographs and 3\6
left thumb impression in the surety bond and the Court concerned may obtain a copy of their Aadhar Card or Bank pass Book to ensure their identity;
(b)The petitioners 1, 2 and 5 shall report before the respondent police on every Saturday at 10.30 a.m. for a period of eight weeks and thereafter, as and when required for further interrogation; The petitioners 3 and 4 shall report before the respondent police as and when required for interrogation; (c)the petitioners shall not tamper with evidence or witness either during investigation or trial;
(d)the petitioners shall not abscond either during investigation or trial;
(e)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; 4\6
(f)if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
