representation, dated 07.04.2025, and thereby direct the respondents 1 to 4 to erect the mile stones by way of measuring the property and issue a separate Patta in the name of the petitioner in Survey No.434/1, 434/2 and 603/2B, total extent of 1.92 cents, situated at Irumporai Village, Mettupalaiyam Taluk, For Petitioner : Mr.B.Sundarapandiyan For Respondents 1 to 4 : Mr.A.Selvendran, Spl.Govt. ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to the 5th respondent is dispensed with.

This Writ Petition is filed for a mandamus to direct respondents 1 to 4 to consider petitioner's online application, dated 27.04.2024, and reminder representation, dated 07.04.2025, and to further direct the respondents 1 to 4 to conduct survey of the property and issue separate Patta in the name of the petitioner in respect of the lands comprised in Survey No.434/1, 434/2 and 603/2B, measuring an extent of 1.92 cents, situated at Irumporai Village,

Mettupalaiyam Taluk, Coimbatore District.

3. According to the petitioner, he is the absolute owner of the subject property and has been in possession and enjoyment of the same. However, patta for the said property stands in the name of petitioner and fifth respondent. Therefore, he submitted an online application, dated 27.04.2024, for separate patta and, thereafter, a reminder representation, dated 07.04.2025, before the official respondents. The same were not considered. Hence, he has come before this Court by way of this writ petition.

Mr.A.Selvendran, learned Special Government Pleader, appearing for the official respondents, would submit that the request of the petitioner would be considered by the respondents, after issuing notice to petitioner and fifth respondent, in compliance with the provisions of the Tamil Nadu Patta Pass Book Act and the Rules.

5. In view of the above, the respondents 1 to 4 are directed to consider the online application of the petitioner, dated 27.04.2024, and reminder representation, dated 07.04.2025, seeking survey of the subject property and issuance of separate patta in the name of the petitioner, and pass appropriate

orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order, after issuing notice to petitioner, fifth respondent, and any other interested parties, including rival claimants, if any. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.

6. Writ Petition stands disposed of accordingly. No costs. 29.07.2025 NCC :
