ORDER
This application has been filed to grant leave to institute the present suit against the respondents/defendants on the file of this Court.
2. The learned counsel appearing for the plaintiff/applicant pointed out that, with regard to the cause of actions, he referred to page no.167 of the typed set of papers, where the Employee Non-solicitation Agreement ("Agreement"), was entered into between the plaintiff and the defendant namely, Yoganand on 2/9
01.04.2024, wherein, the defendant's address is shown as Chennai 64.
3. The learned counsel for the plaintiff submitted that the applicant/plaintiff has achieved significant recognition among numerous Physician Offices in the United States of America, relying on its unblemished record in providing Medical Billing Services. Further, she submitted that the 1 st defendant, an LLP, was established with a malicious intention to exploit the goodwill of the plaintiff's company and to cause irreparable loss and harm to the plaintiff, which is nothing but a blatant case of "moonlighting".
4. Without going into the merits of the case as averred by the plaintiff, and on perusal of the plaint averments, it is seen that no part of cause of action has been established by the plaintiff, and therefore, the prayer sought in this application cannot be granted.
5. Further, it appears that, in the said agreement dated 01.04.2024, there is no clarity in the signature affixed on the right side, which according to the 3/9
plaintiff is the signature of the defendant.
