The above applications have been filed (i)to condone the delay of 913 days in filing an application to set aside the abatement for not taking necessary steps to bring on record the legal heirs of the 6th defendant, (ii) to set aside the abatement and (iii) to bring on record the legal heirs of the deceased 6th defendant respectively.

All the three applications are allowed.

Plaintiff is to carry out necessary amendment in the plaint today.

Ms.G. Sumitra, learned counsel takes notice for the proposed defendants. Learned counsel submitted that she will be filing vakalath for the proposed defendants.The proposed defendants are impleaded as defendants 13 to 16.
