SALEM DISTRICT-636 112 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed in para No.6(a) i.e. "the petiitioner is directed to deposit a sum of Rs.20,000/- (Rupees Twenty Thousand Only) to the Tamil nadu Advocate Clerk Association, Chennai within a period of two weeks from the date of receipt of a copy of this order and shall produce the said receipt before the court below" in the above Crl.O.P.NO.21635 of 2021 order dated 18.11.2021. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.L.MUTHUSAMY, Advocate for the Petitioner and of MR.A.
GOKULAKRISHNAN, Additional public Prosecutor on behalf of the Respondent the court made the following order:- This Court by its order dated 18.11.2021 in Crl.O.P.NO.21635 of 2021 granted anticipatory bail to the petitioner on the ground the petitioner, on his own volition was ready to deposit a sum of Rs.20,000/- to the credit of the Tamilnadu Advocates Clerks Association, Chennai as imposed by this Court.
2. This petition has been filed by the petitioner to modify the aforesaid condition as imposed by this Court in Crl.O.P.No.21635 of 2021 dated 18.11.2021.
3. The learned counsel for the petitioner submits that in the present financial situation, the petitioner is unable to pay the entire amount of Rs.20,000/- as ordered by this Court and hence, seeks for modification of the condition and a lesser amount be imposed.
4. Taking into consideration the facts and circumstances of the case, and also the pandemic situation, though the petitioner on his own volition came forward to pay the said amount, in the interest of justice, an amount of Rs.20,000/- as found in the paragraph No.3 and 6(a) respectively shall stand substituted with Rs.15,000/-.
5. Registry is directed to incorporate the necessary correction in the order dated 18.11.2021 and issue a fresh copy of the order to the learned counsel for the parties.
6. Accordingly, this petition is modified. All other conditions remain unaltered.
