Crl.M.P.No.15473 of 2022 in Crl.A.No.227 of 2022 P.VELMURUGAN, J.

This petition has been filed to relax the condition imposed by this Court by order dated 12.04.2022 in Crl.A.No.227 of 2022, and by which this Court, directed the petitioner to appear before the respondent-Police, on every Monday at 10.30 a.m. until further orders.

2. The learned Additional Public Prosecutor, on instructions, would submit that charge sheet has already been filed and the case is taken on file in Special S.C.No.06 of 2019, on the file of the learned Principal District & Sessions Judge, Tiruppur.

3. A perusal of the records, it could be seen that after issuing summons, the petitioner/accused did not appear and hence Non-bailable warrant was issued and thereafter, he was secured. Therefore, if the condition imposed on him is relaxed, there is every possibility of absconding from the clutches of law and tampering the witnesses.

4. Considering the gravity of offence and the antecedents of the petitioner/accused and also taking the fact that charge sheet has been filed, this Court is not inclined to relax the condition and hence, the petition is dismissed. The trial Court is directed to conduct trial on day to day basis and complete the trial within a period of four months from the date of receipt of a copy of this order and file a report before this Court. Accordingly, the criminal miscellaneous petition is dismissed.
