(Order of the Court was made by S. M. SUBRAMANIAM, J.) This Civil Miscellaneous Petition has been filed to condone the delay of 24 days in filing the above Appeal.

2. When the matter is taken up for hearing today, there is no representation on behalf of the petitioner.

3. Mr.K.Malaikannu, learned counsel appears on behalf of the 2nd respondent and reports no objection for allowing this petition.

4. Even though the learned counsel appearing for the petitioner has not appeared today, this Court is of the view that the delay is only 24 days in preferring the appeal. Hence, we are inclined to allow this petition.

5. Accordingly, this Civil Miscellaneous Petition is allowed and the delay of 24 days is filing the appeal is condoned.
