Respondent Prayer:- Petition has been filed under Section 482 of Cr.P.C. to modify the condition imposed on the petitioner herein by the learned Principal Sessions Judge, Dharmapuri in Crl.M.P.No.266 of 2016 vide order dated 12.02.2016 as two normal surety instead of one of the surety should be a Government Servant. O R D E R

This petition is filed to modify the condition imposed on the petitioner in Crl.M.P.No.266 of 2016, dated 1202.2016 on the file of the Principal Sessions Court, Dharmapuri. 2.Learned counsel appearing for the petitioner submits that while the petitioner was enlarged on bail, he was directed to execute a bond for a sum of Rs.10,000/- along with two sureties each likesum to the satisfaction of the Judicial Magistrate No.I, Dharmapuri and one of the surety should be a Government Servant. He further submitted that he was not able to get the Government Servant. Therefore, he prays for modification to that extent.

3.Heard the learned Additional Public Prosecutor appearing on behalf of the respondent.

4.Considering the submissions made on both sides, this Court is inclined to modify the condition imposed by the learned Principal Sessions Judge, Dharmapuri in Crl.M.P.No.266 of 2016 dated 12.02.2016 to the extent that one surety must be a close relative, viz., parents, brothers or sisters, instead of a Government Servant.
