Application No.1229 of 2017 in T.O.S.No.40 of 2023 N.SATHISH KUMAR.J., This Application has been filed seeking to withdraw the suit in O.S.No.13897 of 2010 pending on the file of the learned VII Additional Judge, City Civil Court, Chennai and to transfer the same to the file of this Court for joint trial along with T.O.S.No.40 of 2003 pending on the file of this court.

2. Today, when the application was taken up for hearing, the learned counsel for the applicant submitted that the suit which is sought to be transferred to the file of this Court had been dismissed on 12.07.2023 for the default of the plaintiffs and thus, nothing survives for further adjudication in the application. He has also produced a copy of the judgement dated 12.07.2023 made in O.S.No.13897 of 2010 by the learned VII Additional Judge, City Civil Court, Chennai.
