ORDER

The writ petition is filed for the below relief: "directing the Respondents to disburse 6% interest for belated payment of Provident Fund, Gratuity and leave Liability amount within the stipulated time ".

2. The brief facts which are culminated in the filing of this writ petitions are set out below:

2.1. It is the case of the prosecution that the petitioner's husband had joined as a Driver in Annai Sathiya Transport Corporation, Dharmapuri now renamed as Tamil Nadu State Transport Corporation (Salem) Ltd, Dharmapuri region on 09.08.1992. Thereafter, he died while he was in service on 10.05.2021. At that time, he was serving as 'Selection Grade Senior Driver' in the 2nd respondent Corporation. It is the submission of the petitioner that the retirement benefits were settled belatedly on 30.03.2023 and 04.04.2023, without any interest. Hence, the petitioner had sent a representation to the respondent on 14.05.2025 to settle the interest for the belated payment of retirement benefits.

3. Heard the learned Counsels on either side and perused the records.

4. Admittedly, the retirement benefits has been paid belatedly for no fault of the petitioners. Therefore, the petitioner is entitled to interest on the same. Therefore, the Writ petition is allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interst for belated payment of Provident fund, Gratuity and leave liability amount within a period of one (1) month from the date of receipt of copy of this order.
