ORDER
The petitioner who was arrested and remanded to judicial custody on 02.06.2025 for the offence punishable under Section 278, 123 and 61 (2) of BNS Act 2023 in Cr.No.198 of 2025 registered on the file of the respondent, seeks bail.
2.The case of the prosecution is that the petitioner along with other accused was found in illegal possession of 100mg of Tapentadol - 460 Tablets for selling near educational institutions. Hence, the case.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that petitioner is in judicial custody from 02.06.2025 and hence further custody of the petitioner is not required. Hence, he prayed for grant of bail to the petitioner. 4.The learned Government Advocate (Criminal side) reiterated the prosecution case and submitted that the petitioner is having two previous cases pending in Cr.No.340 of 2024 under NDPS Act and Cr.No.109 of 2025.
5.Heard the learned counsels on either side and perused the materials on record. 6.Considering the nature of offence, the fact that petitioner is having two previous cases, and since custodial interrogation of the petitioner is very much required, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 23-07-2025
