By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

2. The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the 2nd respondent to pay Rs.90,029/- towards balance interest for the commutation of pension amount to the petitioner.

3. Heard the learned counsel for both sides and perused the materials available on record.

4. The learned counsel for the petitioner would submit that the 2/6

petitioner has joined in the services of the 2nd Respondent-Transport Corporation as Assistant Store Keeper on 21.06.1982 and after rendering 34 years of service, he retired from service on 31.05.2016 as Selection Grade Assistant Engineer. Thereafter, the pension revision and interest for commutation amount was not paid fully to the petitioner. Hence, he has sent a representation to the 2nd respondent on 25.03.2025 and such representation is pending with the 2nd respondent.

Per contra, the learned Standing Counsel appearing for the 1st respondent and the learned Standing Counsel appearing for the 2nd respondent would submit that the entire claim of the petitioner has been settled and the contempt petition were also closed based upon the above submission of the respondents. Hence, prayed to dismiss the writ petition.

Though there is a disputed facts, the fact remains the petitioner's representation dated 25.03.2025 is yet to be considered, in such view of the position, without going into the merits of the writ petition, this Court deems it appropriate to direct the 2nd respondent to consider the petitioner's representation dated 25.03.2025 and pass orders on it's own merits and in 3/6

accordance with law, within a period of eight weeks from the date of receipt of copy of this order.

7. With the above direction, the Writ Petition is disposed of. No costs. 24.07.2025 Index : Yes/No Speaking order /Non Speaking Order dm 4/6
