This application has been filed by the applicant/1st defendant to order joint trial of C.S No.53 of 2015 along with TOS No.9 of 2011 pending on the file of this Court.

2. The learned counsel for the 1st respondent/plaintiff has strongly opposed to order for joint trial, however, he accepts for simultaneous trial.

3. Considering the facts and circumstances of the case, simultaneous trial is ordered.

Accordingly, this application is disposed of.
