ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner seeking to modify the conditions that (i) the petitioner/accused A1 is directed to 1/4

execute a bond for Rs.25,000/- along with two sureties for the same amount and the sureties shall produce their Aadhar Card, Ration Card/PAN Card to the satisfaction of this Court and (ii) the petitioner/accused shall stay at Trichy Special Camp and he shall appear and sign before the officer in-charge of the said Camp daily at 10.00 a.m., and 5.00 p.m., until further orders from the date of release imposed in the order passed by the Additional Chief Metropolitan Magistrate, Egmore, Chennai in Crl.M.P.No.52501 of 2023, dated 21.11.2023 in Crl.M.P.No.46913 of 2023.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent.

3. Considering the facts and circumstances of the case, this Court is inclined to modify the conditions imposed by an order dated 21.11.2023 in Crl.M.P.No.52501 of 2023 by the Additional Chief Metropolitan Magistrate, Egmore, Chennai as follows:

"(i) the petitioner/accused A1 is directed to execute a bond for Rs.25,000/- along with two sureties for the same amount and the sureties shall produce their Aadhar Card, Ration Card/PAN Card to the satisfaction of this Court is stands confirmed; and 2/4

Since the petitioner is a currently residing at Bangalore, the respondent shall communicate the bail order to the concerned Registration Officer appointed under Rule 3 of Registration of Foreigners Rules, 1992 as per the decision of the Hon'ble Supreme Court in Frank Vitus vs. Narcotics Control Bureau and others in Crl. Appeal Nos.2814-2815 of 2024 dated 06.01.2025.

[ii] the petitioner shall appear for every hearing before the Trial Court regularly without fail. If any deviation in complying the conditions, bail granted to the petitioner shall stand cancelled;

4. Accordingly, this Criminal Miscellaneous Petition stands partly allowed.
