ORDER
This writ petition is filed seeking for the issuance of Writ of Mandamus 1/4
to direct the 1st and 2nd respondents to dispose of the petition presented on 16.02.2022 and to initiate criminal action against the 4th to 6th respondent under section 64 of the Registration Act
2. The case of the petitioner is that the property comprised in Survey No.558/2D1 situated at Agasiappali Village, Krishnagiri, admeasuring 0.4.95 ares is their ancestral property, wherein, his father namely Muniappan name was entered in the revenue records. While so, the petitioner's father died on 16.04.1995, to which, legal heirship certificate has also been obtained. Further, the petitioner came to know that the respondents 4 and 5 has sold the subject property to sixth respondent by fabricating documents. Aggrieved, the petitioner made a representation to the first respondent on 16.02.2022 and on 10.06.2022, the petitioner was issued with a summons by the first respondent in Na.Ka.No.1422/O/2022 and the petitioner appeared before the first respondent on 22.06.2022. However, till date, no order is passed. Hence, this petition.
3. The learned counsel for the petitioner seeks this Court for issuance of direction for the first respondent to conclude the proceedings in Na.Ka.No.1422/O/2022 dated 10.06.2022 within a reasonable time as fixed by 2/4
this Hon'ble Court.
4. Heard the learned Additional Government Pleader appearing for the respondents and perused the materials available on record.
5. Considering the limited relief sought for by the petitioner, this Court directs the first respondent to conclude the proceedings in Na.Ka.No.1422/O/2022 dated 10.06.2022, pass orders on merits and in accordance with law, after providing opportunity of hearing to the petitioner well as any other interested parties, within a period of twelve weeks from the date of receipt of copy of this order.
