Crl.O.P.No.4178 of 2016 S.VIMALA, J.

The petitioner / A-3, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 323, 364[A] and 506[ii] of IPC in Crime No.166 of 2016 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that due to money dispute, the petitioner along with two others had abused the de facto complainant and also assaulted him by hands.

3.It is represented by the learned counsel appearing for the petitioner that the co-accused has already been released on bail by the Sessions Court, Kancheepuram and this petitioner can also be granted anticipatory bail.

4.According to the learned Government Advocate [Criminal Side], the co-accused, namely, A-1 and A-2 were granted regular bail and this petitioner seeking anticipatory bail and hence, he opposed to grant anticipatory bail to him.

5.In such circumstances, the petitioner is directed to surrender before the Sessions Court, Kancheepuram and the Sessions Court, Kancheepuram shall pass orders on the bail application on the same day, on merits and in accordance with law.
