PRAYER: Criminal Original Petition filed under Section 482 of Crl.P.C, to transfer the investigation in Crime No.408 of 2019 pending on the file of the second respondent to CBCID and to file final report in the time bound manner.

The individual against whom the petitioner had given a complaint which has been registered in Crime No.408 of 2019 has now been transferred and posted in Triplicane Police Station, Chennai, where the investigation in Crime No.408 of 2019 is pending. In these circumstance, it would not be proper that the Inspector of Police, Triplicane Police Station to investigate the offences.
2.Further more, since the person against whom the petitioner has filed the complaint, happens to be the very Inspector of Police and such an investigation against the petitioner's complaint also requested to be conducted by a person, who holds higher rank than the Inspector of Police. 3.In view of the aforesaid facts, the investigation in Crime No.408 of 2019 pending on the file of the Inspector of Police, D1, Triplicane Police Station, is directed to be transferred to the Assistant Commissioner of Police, T-Nagar Police Station, Chennai, who shall conduct a fresh investigation on the petitioner's complaint and file a final report as expeditiously as possible, in any event within a https://hcservices.ecourts.gov.in/hcservices/
period of 3 months from the date of receipt of a copy of this order.
4.Such an investigation to be conducted by the Police Station concerned and has to be monitored by the Deputy Commissioner of Police, having jurisdiction over the Assistant Commissioner of Police, T.Nagar Police Station. 5.With these above observations, this Criminal Original Petition stands disposed of.
