Dr.P.Devadas Manoharan v. Dr.J.Prakash,

2024-11-08Honourable Mr Justice D. Krishnakumar,Honourable Mr Justice P.B. Balaji3 pages

Sub appln.No.862 of 2024 in Cont.Petn.No.979 of 2024 D.KRISHNAKUMAR, J.

AND P.B.BALAJI, J.

This petition has been filed to reopen the contempt petition No.979 of 2024, which was closed on 22.07.2024.

In the above contempt petition, the counsel for the respondent submitted that, already, terminal benefits payable to the petitioner was calculated, however, due to non furnishing of requisite information, the order passed in W.A.No.3553/2019 dated 10.08.2023 was not complied with.

Learned counsel for the petitioner has given assurance to give requisite information to the respondent and also sought liberty to make objection to the calculation memo, if any furnished by the respondent. Granting such liberty, the above contempt petition was closed on 22.07.2024. Now, it is contended by the petitioner that the terminal benefits has not been fully settled by the respondent and they have not calculated his retirement benefits accurately. The further contention of the petitioner is that though he has raised objection, it was not considered by the respondent and hence, the contempt proceedings have to be re-opened. In our view, the prayer as sought for by the

petitioner cannot be granted and if the petitioner is aggrieved by the act of the respondent, it is open to the petitioner to challenge the same in the manner known to law.

Accordingly, this petition is closed.
