Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 4th Respondent/District Collector, Tiruvallur to consider and pass order on the representation made by the petitioner dated 13.04.2022 for the exchange of lands as er the guidelines issued in G.O.M.S.No.201/dated/10/05/2022 and pass orders. The petitioner has filed this writ petition seeking a direction to the 4th Respondent/District Collector, Tiruvallur to consider and pass orders on the representation made by the petitioner dated 13.04.2022.
2. The learned Additional Government Pleader takes notice for the official respondents. In view of the consent expressed by the learned counsel appearing for either side, this petition is taken up for final disposal. 3.The case of the petitioner is that the petitioner's husband/A.G.Ulaganathan purchased the subject property. After the demise of the said A.G. Ulaganathan petitioner and her two daughters who are the 2/5
legal heirs of the deceased became the owner of the subject property. The grievance of the petitioner is that it is proposed for exchange of certain portions of the subject property for proper ingress and egress and to have a direct access to the main road and to get uninterrupted access to the pond for the purpose of cultivation. Hence the petitioner made a representation to the third respondent on 13.04.2022 for exchange of the land. However the same was not considered. Hence, this writ petition is filed with the aforesaid prayer.
4. The learned counsel appearing for the petitioner submitted that the it would suffice, if this Court issues direction to the third respondent to consider the petitioner's representation dated 13.04.2022 and pass appropriate orders within a reasonable time fixed by this Court.
5. The learned Additional Government Pleader appearing on behalf of the respondents submitted that the petitioner's representation dated 13.04.2022 will be considered within a reasonable time fixed by this Court.
6. Considering the limited request made by the petitioner, this Court 3/5
is inclined to direct the respondents to consider the petitioner's representation dated 13.04.2022 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
7. With the above terms, this present writ petition is disposed of. No costs.
