PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., pleased to direct the 1st Respondent to transfer the case in Crime No.71/2014 from his file to the 2nd respondent and conduct fresh/further investigation of the case and file a final report within a time frame fixed by this Honble Court.

O R D E R

This petition has been filed to direct the first respondent to transfer the case in Crime No.71/2014 from his file to the second respondent and conduct a fresh/further investigation of the case and file a final report within a specified time frame.

2. Mr.S.Sathia Chandran, Learned Counsel for the petitioner, submitted that the change of vakalat and the entire bundle have already been handed over to the petitioner. Even then, the petitioner failed to engage any new counsel on record to appear before this Court.

3. Today, when the matter was called, no new counsel on record appeared before this Court, and the petitioner also failed to appear before this Court.

4. Furthermore, Mr.R.Vinothraja, Learned Counsel for respondents 1 to 3, submits that the investigation in Crime No. 71/2014 has already been completed and closed as a mistake of fact. In fact, on receipt of the referred charge sheet notice, the petitioner filed a protest petition which was dismissed and the closure report was accepted by the concerned jurisdictional Court.

5. In view of the above, no investigation is pending on the file of the second respondent. Accordingly, this Criminal Original Petition is dismissed.
