A.No.6465 of 2019 in C.S.No.762 of 2015 K.KALYANASUNDARAM, J., Heard Mr.B.Mohanraj, learned counsel for the applicants/ plaintiffs and Mr.S.Ramesh, learned counsel for the respondents / defendants 1 and 3 .

This application has been filed seeking to delete the words "plaintiffs 1 to 4 are represented by their duly constituted and appointed Power of Attorney viz., Mrs.Charijah Binti Ameerdin Mohamed Shariff, residing at 28, Sommerset Close No.1, Jalan Yaacob Latif, Bandar Tun Razak 56000, Kuala Lumpur, Malaysia" from the short cause title, long cause title and statement of address and wherever it is found in the plaint in C.S.No.762 of 2015.

3. The learned counsel for the applicants would submit that the suit was filed for declaration and partition and the plaintiffs were represented by their power agent. The learned counsel would further submit that the mother of the applicants are not able to represent due to her illness. Hence, this application may be allowed.

4. The learned counsel appearing for the defendants 1 and 3 have no Page No.1/3

serious objection for allowing this application.

5. Considering the averments made in the affidavit filed in support of the application and also considering the submissions made by the learned counsel on either side, this application is allowed. 03.09.2019 ms Page No.2/3
