ORDER
The petitioner has come forward with this petition seeking a direction to the second respondent to register the petitioner's complaint dated 06.10.2014.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.
3.The learned counsel appearing for the petitioner would submit that the respondent has neither enquired the matter nor registered the case and hence, the petitioner has come forward with this petition for the above stated relief. 4.The learned Additional Public Prosecutor would submit that the matter was taken by the Deputy Superintendent of Police, District Crime Branch and enquired and closed since the matter https://hcservices.ecourts.gov.in/hcservices/
more of civil in nature and hence, prayed for the dismissal of the petition.
5.Considering the rival submissions made on both side and on perusal of typed set of papers, it is known that the property originally belonged to one Vedachalam Reddiar and this petitioner and others are the children of Vedachalam. The case of the petitioner is that his other brother obtained partition and sold the property and since he is one heir of Vedachalam, he want his share. It is purely civil in nature. Hence, recording the submissions of the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed. However, the petitioner is at liberty to approach the appropriate forum for remedy.
