By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself. 1/4

The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondent to pay the petitioner the amounts, payable towards the encashment of 60 days of earned leaves surrendered by him in the years before his retirement and Employees Retirement Benefit Scheme, as admitted by the respondent in the RTI information dated 30.05.2025 and 31.05.2025, together with 18% interest from the respective due dates, within a time frame as may be fixed by this Court.

3. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that the petitioner was appointed as Conductor in the Respondent-Transport Corporation on 27.07.1985 and after completion of 32 years of service and on attaining the age of superannuation, he retired from service on 28.02.2017 as Senior Checking Inspector. The learned counsel for the petitioner would further submit that he has sent a representation to the respondent on 02.06.2025 claiming the payment of earned leave along with interest and such representation is yet to be considered by the respondent. Therefore, the present writ petition has been filed.

5. At this juncture, the learned Standing Counsel appearing for the respondent would submit that they will consider the petitioner's representation according to it's own merits and in accordance with law, within a reasonable time.

In such view of the submission, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondent to consider the petitioner's representation dated 02.06.2025 and pass orders on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.
