ORDER
The present wit petition has been filed with a prayer for Mandamus, to direct the respondent to pay the petitioner the amounts, payable towards the encashment of 30 days of earned leaves surrendered by him in the years before his retirement and Employees Retirement Benefit Scheme, as admitted by the respondent in the RTI information dated 15.05.2025 and 17.05.2025 together with 18% interest from the respective due dates, within a stipulated time.
2. The case of the petitioner is that he joined in the 1st respondent Corporation on 15.12.1985 and had retired from his service on 31.03.2017. The learned counsel for the petitioner submitted that for claiming the 30 days earned leave surrendered amount towards the Employees Retirement Benefit Scheme, the petitioner has sent a representation on 02.06.2025 to the respondent and such representation is pending for consideration on the file of the respondent.
3. At this juncture, the learned Standing Counsel appearing on behalf of the respondent would fairly submit that he will consider the above said representation of the petitioner and pass orders within a reasonable time. 2/4
4. Heard the learned counsel on either sides and perused the materials available on record.
5. In view of the said fair submission made by the learned Standing Counsel for the respondent, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondent to consider the petitioner's above representation dated 02.06.2025 and pass orders according to its own merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.
6. With the above observations, the Writ Petition stands disposed of. No costs.
