O R D E R

The petitioner was granted bail by the Lower Court in Crl.M.P. No.5219 of 2025 on 19.06.2025. It is alleged that the petitioner had received a sum of Rs.44,04,000/- from the de-facto complainant, out of which he had repaid only Rs.18,00,000/-. Hence, a case was registered against him. 1/4

2. At the time of filing the bail petition, the petitioner voluntarily gave an undertaking that he was willing to deposit a sum of Rs.10,00,000/- to the credit of the crime number. Based on this undertaking, the learned Principal Sessions Judge, Chennai, granted bail.

3. Subsequently, the petitioner has filed the present petition seeking modification of the bail condition. He contends that he has already returned a sum of Rs.23,00,000/- and has submitted an unauthenticated statement showing receipt of Rs.23,81,000/-.

4. The learned counsel for the petitioner submits that the petitioner is unable to comply with the condition of depositing Rs.10,00,000/-. Although bail was granted approximately one and a half months ago, the petitioner is still in custody, as he has been unable to mobilize the required funds and, consequently, has not been able to execute the bond or produce sureties.

5. The learned counsel further submits that the petitioner is now willing to deposit a sum of Rs.5,00,000/- to the credit of Crime No.121 of 2025. Given that more than one and a half months have passed since the grant of bail, and the petitioner continues to be in prison solely due to his inability to fulfil the condition, it is prayed that the bail condition be modified. 2/4

In view of the above, it is respectfully submitted that the condition requiring the petitioner to deposit a sum of Rs.10,00,000/- may be modified, and the petitioner may instead be directed to deposit a sum of Rs.5,00,000/- to the credit of Crime No.121 of 2025. The said amount may be deposited into an interest-bearing account to the credit of the lower court.
