ORDER

The petitioner has come forward with this petition under Section 482 of Code of Criminal Procedure, seeking a direction to the respondent to complete the investigation in crime No.5 of 2015 on the file of Economic Offences Wing-II, Anna Nagar, Chennai within a time frame and file a final report before the Competent Court and pass appropriate direction to them to recover the money of the petitioner.

2. Heard the submissions made by the learned counsel appearing on either side.

3. The learned Additional Public Prosecutor has filed a detailed status report stating that based on the report given by one Dr.Ranjit Chitturi, already a case has been registered https://hcservices.ecourts.gov.in/hcservices/

against the accused company on 1.4.2015 for the offence punishable under Section 5 of Tamilnadu Protection of Interests of Depositors (In Financial establishments) Act 1997 and 420 IPC.

Learned Additional Public prosecutor submitted that the petitioner, who is one of the depositors in the accused company has come forward with this application for earlier investigation and as per the status report, the issue involves huge amount of Rs.55,25,70,000/- which was deposited by nearly 6540 depositors from all over India and the depositors who have deposited their monies in the accused company are now coming with complaints one after the other. He would further submit that investigation in this case is still going on.

5. According to the learned Additional Public Prosecutor, as the depositors are coming with complaints day by day, the investigation is still going on. Under such circumstances, I am of the view that this is a fit case for giving a direction to the respondent to investigate the matter as expeditiously as possible and file a final report at the earliest point of time.

6. The Criminal Original Petition is disposed of with the above direction.
