in C.P.No.388 of 2014 ABDUL QUDDHOSE.J., This application has been filed seeking leave of this Court to file the applicant's claim petition before the Official Liquidator.
2. Admittedly, there is a delay in lodging the claim. The respondent company was wound up by this Court by its order dated 01.10.2015 and the Official Liquidator was appointed. Since the applicant's claim is beyond the prescribed period, this application has been filed seeking leave of this Court to file the applicant's claim before the Official Liquidator.
3. The learned Official Liquidator has not raised any serious objection for allowing this application, if the same is allowed without prejudice to the rights of the Official Liquidator while adjudicating the claim of the applicant.
4. This Court has also perused and examined the reasons given by the applicant for the delay in lodging the claim before the Official Liquidator 1/3
and is satisfied of the same. No prejudice will be caused to any of the parties, if this application is allowed without prejudice to the rights of the Official Liquidator while adjudicating the claim to be lodged by the applicant. Accordingly, this application is allowed as prayed for, without prejudice to the rights of the Official Liquidator with regard to the claim of the applicant while adjudicating the applicant's claim. The applicant is directed to lodge the claim before the Official Liquidator in Form No.66 within a period of 15 days from the date of receipt of a copy of this order. 11.09.2023 rkm 2/3
