J U D G M E N T
(Judgment of the Court was delivered by R.SUBRAMANIAN, J.) Aggrieved by the order of the writ Court made in W.P.No.15800 of 2024 the Institute is on appeal.
2. By the said order, the writ Court had directed relaxation of age on accepting the claim of the petitioner in the Writ Petition, that since he had worked in another National Institute of Technology on an adhoc basis he would be entitled to relaxation.
3. We are not invited to go into the merits of the issue due to the subsequent developments. Though the Writ Petition was allowed, on Institute filing the Writ Appeal, this Court permitted the respondent to participate in the selection process subject to the outcome of the Writ Appeal. It is stated that the respondent was not successful in the recruitment precess. However, Mr.K.Srinivasa Murthy, learned counsel 2/5
appearing for the appellant would submit that the observations of the learned Judge regarding the scope of age relaxation criteria may serve as a precedent in future.
4. Since we have not examined the correctness of the conclusion of the learned Single Judge, in view of the subsequent developments, we make it clear that the legal issues are left open.
